decisions more severe than the requisitions of the ministry

The decisions have just fallen into the vast file of corruption at the CASBT which occupied the justice system for ten days. Overall, the penalties are more severe than the requisitions of the public prosecutor’s office and part of the conclusions of the civil party of the Greater South Caribbean-Guadeloupe Agglomeration Community is accepted.

After about six hours of deliberation, the three magistrates composing the correctional court rendered their decisions. Decisions much more severe than the requisitions of the public prosecutor. Apart from Jean-Luc Devouton who sees his release confirmed, all the other defendants are found guilty

Thus Fred Madinecouty is sentenced to 4 years in prison, 2 of which are suspended and a fine of 175,000 euros. Hervé Belan and Franck Chevrere, the two main leaders of Aqua TP receive an identical sentence of 3 years including 18 months suspended and a fine of 200,000 euros for one, 150,000 euros for the other.

The eleven other defendants were sentenced to suspended prison terms ranging from 4 to 10 months, together with fines ranging from 5 to 10,000 euros.

While recognizing the termination of the public action against Lucette Michaux-Chevry, the court confirms the seizure of her life insurance of 345,000 euros, arguing that the former president of the CASBT was the cornerstone of ‘a system.

Finally, the court ruled in favor of the Greater South Caribbean Agglomeration Community, which had instituted civil proceedings and found in favor of part of the damages claimed, i.e. nearly 1.5 million euros that will have to be paid jointly all or part of the 14 convicted.
