consequence of the exemption from waiting days, the employer can now know the reason for the sick leave

Women who have suffered miscarriages have been exempt from waiting days since January 1. A step forward, but one that can harm them in business, because the employer can guess the reason for their work stoppage.

A social advance which subsequently reveals disadvantages. Since January 1, women who have suffered miscarriages have been exempt from waiting days by Health Insurance. But benefiting from this provision can in certain cases have an undesirable consequence.

Because miscarriage is a unique case of exemption from waiting days by Health Insurance. For the 60% of employees who benefit from subrogation, that is to say the maintenance of salary during sick leave, the employer will be informed indirectly, by deduction, of the reason for the work stoppage, when Health Insurance will pay him daily allowances without any deficiency. And knowing that her employer is informed of her desire for maternity risks deterring women from benefiting from the system.

Health Insurance warns affected patients

“I think this will prevent a very large number of women from benefiting from this advance, believes Sandra Lorenzo, co-founder of the False Carriage, True Experience collective. Before this law came into effect, there were a number of women who were not arrested because there was this financial condition. There may be very important health conditions for a woman not to take time off work when she is experiencing a miscarriage.”

For its part, Health Insurance simply warns the patients concerned of the risk that their employer will know the reasons for their cessation and gives them the possibility of waiving the exemption from deficiency. But the organization does not seem to have a solution as it stands to avoid this inconvenience.
