The trial of the alleged murderer of Shaïna, in 2019 in Creil, begins Monday, June 5 before the Assize Court for minors of Oise in Beauvais. The young man, who had an affair with her, will be tried for murder. He faces life imprisonment.

Her name was Shaïna Hansye, she was 15 years old. She burned to death after being stabbed several times. The drama happened in a city, the Plateau du Rouher in Creil (Oise) in October 2019. Alerted by teenagers, the police of Creil had discovered the charred remains of Shaïna near a shed, under debris. A trunk and a skull, face down. The second high school student had been stabbed and then set ablaze alive by the hair. A chilling modus operandi.

Also chilling, the journey of the young girl: victim three times. At 13, Shaïna had suffered what in the city is referred to as a rotation: a gang rape. For having dared to lodge a complaint, she had been beaten up afterwards and singled out as an informer and an easy girl. The most insulting qualifiers circulated. According to the prosecution, the one who will be in the box had an affair with Shaïna precisely because he considered it easy. He wouldn’t have supported her getting pregnant afterwards. One of the man’s fellow prisoners later confided that he had said to him: “Rather take thirty years in prison than be the father of a bastard”. Another certifies that he would have explained to him that he killed his girlfriend “because she was a whore”that he had “getting pregnant”and that he was not “no question that his mother finds out”.

The experts who examined the respondent describe a “unstructured neurotic organization”an individual with “a passion for one’s own image” and a certain “detachment” about the facts with which he is accused.

The trial will likely be held behind closed doors

Shaina’s older brother, Yasin Hansye, 24, says he hopes “an exemplary sanction”. “My gaze will meet his for the first time at the start of this trial, but I am not apprehensive of this moment”he said.

“With my parents, we even look forward to facing him. Determined, angry, but dignified.”

Yasin Hansye organizes before the hearing, Monday, June 5, a rally in tribute to his little sister, to whom he was very close. “It is also a gathering for those who would like to support us”he adds. Because they will not be able to do it by coming to attend the hearing. This will most likely be held behind closed doors, the accused being a minor at the time of the events.

The Women’s Foundation asked to be a civil party to this trial, to be represented as an association fighting against violence against women. “This is the first time that we have wanted to stand directly alongside a family victim of feminicide for a trial. This case is terribly emblematic of the hatred that women’s freedom can sometimes arouse”.

Me Negar Haeri, the lawyer for Shaïna’s family, welcomes this initiative. For her, Shaïna’s drama is not a simple news item but a fact of society: “We have to understand how a young girl in France can end up burned alive, can suffer such an ordeal with this end point which expresses the hatred that the perpetrator could have had for who she was.”

“It’s not just Shaïna that we killed, it’s all that she represented, that is to say a free woman. She has not been forgiven for her freedom.”

The accused exchanged numerous text messages with Shaïna on the day of his death. He is suspected of having ambushed him. One of his friends from the neighborhood said that he had collected his detailed account that same evening, step by step, as if he were proud and boasted of what he had just accomplished, with at that moment on his shoes – the boy remembers – red marks, like blood splatters. Confronted later with this testimony, the defendant denounces lies. His DNA was not found at the crime scene, but his cell phone was in the area until 10 p.m., the presumed time of Shaïna’s death, when the device was suddenly turned off.

There is also his leg burn, his redness on his face after the fact, the analysis of his computer which the same evening reveals internet research on judgments and assize courts. The following hours, he will also consult from this PC the many articles that the local press has devoted to Shaina’s death. He will explain that it was just an interest in this affair close to him, and about which, in the neighborhood, unfounded rumors implicating him were circulating.

The accused says he is “completely innocent”

The young man (17 years old at the time, 20 years old today) has, despite this bundle of clues, always denied any involvement in the death of the young woman. Facing the investigators, then facing the investigating judge, he delivered different versions of his schedule on the evening of the tragedy. Often, he preferred not to answer their questions, to remain silent, contenting himself with saying to himself “completely innocent”.

“There is no established proof. We have the terrible feeling that in this case, we started by designating a ready-made culprit, and that we then built a file around this designation to try to show that he was necessarily the author of the facts”, comments Elise Arfi, one of the two lawyers for the accused. According to her, essential investigative acts have not been carried out, serious leads have been neglected, starting with that of individuals who previously attacked Shaïna and who could have resented her for having spoken.

The Oise Minors Assize Court is due to deliver its verdict on Friday, June 9.
