Ali Ngarukiye’s lawyer, this young man accused of having tried to kill Montreal police officer Sanjay Vig in January and then of having murdered a fellow detainee, will challenge the expertise which declared him fit to stand his criminal trial.
The accused was taken Wednesday by 4 colossi of public security in the box of the accused for his appearance in a courtroom of the Montreal courthouse. They stayed close to him, surrounding him throughout the period when his presence was required before the judge.
His lawyer, Me Lloyd Fischler said the psychiatric report filed on Monday, which declared the 22-year-old fit, will be challenged since he requested another assessment of his mental state.
Meanwhile, the accused was glancing furtively at the ceiling, and looked bewildered.
When the judge asked him if he recognized his lawyer, he replied in English: “This is not my lawyer. I don’t have a lawyer. “
Rather, he insisted on “seeing his bag”. When Me Fishler showed him a leather briefcase, the accused asked what was inside. He stopped listening to the judge, sounding nervous that the officers were near him.
The magistrate accepted that he be detained at the Philippe-Pinel Psychiatric Institute pending further proceedings, and not in prison, “given his mental state”.
The second expert’s report on his suitability to stand trial will be filed on January 24, and the psychiatrist will then be questioned in the presence of the judge.
“I want the glass to be cleaned”
The latter then asked the accused if he understood what had just been decided.
“I want the glass to be cleaned. I need to see you well, ”he confined himself to answering the judge, referring to the plexiglass plates which surround the box.
He was escorted out of the courtroom, continuing to ask the judge, “Can I see you?” I want to see you properly. “
In the room were several of his relatives, including a woman who was crying and desperately trying to see him through the glass of the accused box.
The 22-year-old man is the alleged perpetrator of this attack, which occurred last January, on the policeman of the Service de police de la Ville de Montréal (SPVM) for which Mamadi III Fara Camara, an uneventful Montrealer, had been unfairly arrested and detained for six days.
A previous psychiatric examination had come to the conclusion that the accused may be held criminally responsible for the acts with which he is accused.
The arrest warrant filed against him includes a list of seven counts, including attempted murder, aggravated assault of a police officer, disarming a peace officer and discharging a firearm, in addition to two car theft charges.
While in preventive detention, he allegedly murdered the detainee with whom he shared his cell. He therefore also faces charges of murder and contempt of a corpse.
