Access to information: the police hide a recording of her child from her

A citizen of Montérégie is fighting against the police service which still refuses to provide her with the recording of an interrogation with her child, even after having obtained two judgments which prove her right.

When he was 10 years old, Brigitte’s son (fictitious name) met with the Saint-Jean-sur-Richelieu City Police Department to denounce events that occurred in his school environment.

He emerged from this interrogation shaken, says Brigitte, whose real name cannot be published due to a non-disclosure order.

In 2019, knowing that victims of crime can obtain recordings of their interrogation to help them in their healing process, she therefore asked to obtain her son’s file, including the video of the meeting.

The police department refuses, arguing that this would reveal “investigative methods.”

In 2022, the Quebec Commission for Access to Information nevertheless agreed with Brigitte. In a judgment that the Newspaperthe Court of Quebec ruled in his favor again in 2023, ordering the police service to provide him with the recording.

The city is contesting this decision and the case will be examined before the Superior Court.
