A motion to nullify the proceedings has been filed by the lawyer for Lucas L., indicted for the rape and murder of Justine Vayrac last October in Corrèze, in order to challenge the validity of an essential part of the investigation, France Bleu Limousin learned on Wednesday April 19 from the lawyer for the suspect Me Michel Labrousse, confirming information from the newspaper La Montagne.

This motion for nullity was filed this Wednesday before the investigating chamber of the Limoges Court of Appeal. The lawyer for the 21-year-old young man, placed in pre-trial detention since the end of October, believes that the criminal procedure was not respected in the first hours of the investigation, during police custody and the referral to one of the investigating judges.

According to lawyer Michel Labrousse, during the suspect’s custody, from October 25 to October 27, the rights of the defense were not respected. The lawyer points in particular to the lack of systematic assistance from the suspect during the interrogation phases, in particular at the end of police custody during which Lucas L. confessed to the murder of the young woman and the location of the place where she was his body. If the judges of the investigating chamber follow up on this motion for nullity, the elements of the procedure arising from police custody will be cancelled.

The suspect in pre-trial detention since October 27

The 20-year-old young woman disappeared on Sunday October 23, after being seen for the last time around 4 a.m. near a nightclub in Brive-la-Gaillarde, in Corrèze, where she had spent the evening. Two days after his disappearance, a 21-year-old farm worker was arrested and placed in police custody, before being indicted and placed in pre-trial detention.

While in police custody, the man confessed to having killed the young woman after consensual sex. The autopsy revealed that she had been strangled to death. On October 27, shortly after the discovery of the young woman’s body in a wooded area of ​​Corrèze, the suspect was indicted for “rape”, “kidnapping” and “murder preceded by another crime”, and remanded in custody.
