A MoDem deputy from Yvelines resigns after an appeal from one of her opponents

The appeal is based on a point in the Electoral Code which prohibits a substitute for a parliamentarian from standing as a substitute. A by-election will be held in the coming weeks.

MP Anne Grignon, elected under the MoDem label in the second district of Yvelines, announced her resignation on Friday August 12.

Jean-Noël Barrot’s deputy during the legislative elections in 2017 and 2022 became a deputy on August 4, a month after the appointment [du titulaire] to the government as Minister Delegate in charge of the Digital Transition and Telecommunications.

The elected official explains that she wants to take the lead, while her election is the subject of legal action by a “close to a candidate beaten in the first round”. This is based on a provision of the Electoral Code which notably prohibits a “substitute for a member of a parliamentary assembly” to stand as a substitute for a deputy. However, Anne Grignon was in second position behind Jean-Noël Barrot during the senatorial elections of 2017, and only the latter was elected. Due to her second place on the list, Anne Grignon was therefore her de facto replacement.

“I deeply regret this situation. In order to settle it quickly, I have decided, in responsibility, to resign from my mandate”, explained the elected resigner. She denounces “a totally absurd point of law” and according to her “not identified by the instructing services during the examination of the applications”. A new by-election will be held in the coming weeks. If Anne Grignon can no longer be a substitute, nothing prevents her from being a titular candidate to try to recover her seat at the Palais-Bourbon.
