It’s a nightmare that has lasted for almost 12 years. A couple from Azay-sur-Cher (Indre-et-Loire) hired a carpenter in 2009 to work on their roof. Quickly, Sylvie and Philippe Gadin observe defects: the ceiling is crumbling, the floor is sagging. After a complaint and a lawsuit, the family wins the sum of 88,000 euros and begins work to secure their house.
“We lived in the works for almost six months” Sylvie explains, pointing to photographs. “We lived with props in our living room, that was no longer possible. When the supplier had to give us this sum, we very quickly undertook new work. “
Bad surprise for the family: the wood supplier appeals and wins. A reimbursement of 80,000 euros + interest must be made, from the carpenter company responsible for the defects. The latter is however in compulsory liquidation and not solvent. The Gadin family therefore inherits a debt of 91,000 euros.
“It’s still a heavy blow today” deplores Sylvie. “We are not guilty in the eyes of the law, but we are the ones who fear the bailiffs. I send 300 euros per month to pay off an unjustified debt. It should have been our money, we just wanted to rebuild our roofs, not live under the weight of debt! “
A pot to help the couple
After an appeal in Cassation and a letter to the European Court of Human Rights, the couple find themselves at the foot of the wall. A kitty has been launched to help reimburse expenses that Sylvie considers unjustified. “It really is our last resort to have a normal life” specifies the mother of the family.
