Family violence | Victims will be able to get help for their children alone

Parents who are victims of domestic violence will now be able to obtain help for their children without the consent of their abuser.


This is a new measure, already provided for in the context of the reform of family law, adopted last June, but whose entry into force has been brought forward.

Under it, a parent victim of domestic violence, including domestic violence or sexual violence, may request a certificate from a prosecutor from the Director of Criminal and Penal Prosecutions (DPCP) so that his child can benefit from health or social services without the consent of the other parent.

It will not be necessary to have laid charges to benefit from this certificate.

“We want parents who are victims of violence, or those whose children have been, to be able to focus on their reconstruction and to be able to seek all the help they need without fear of being subjected to unhealthy control by the other parent. aggressor,” Justice Minister Simon Jolin-Barrette said in a statement on Thursday.
