The young victim met André Medgino in a business near her home on the evening of October 13, 2020, according to the summary of the facts presented to the judge. She leaves after they exchange phone numbers.

Leaving her residence around supper time, she realizes that the man is still lurking nearby. She tells him to go babysit after a brief discussion.

She joins André Medgino around 11 p.m., once the guarding is over. Her nightmare begins: the aggressor takes her by the hips, embraces her and puts his hand in her panties. He then forces her to turn around, holds her hands behind her back and pulls down her pants. There is complete penetration during the assault.

Back at her home, the 15-year-old girl suffered from stomach pains and bleeding. She goes to the hospital in order to use a forensic kit after notifying her family of the rape she had just suffered. The girl contracted chlamydia as a result of the sexual assault, according to tests carried out the same day.

André Medgino telephones the victim and sends her several voice messages while she is hospitalized. He orders her not to say anything about what happened during the evening.

The man pleaded guilty Monday to one count of sexual assault in the case. André Medgino has admitted his guilt to charges of assault, death threats and breach of conditions.

Background

Death threats, blows to the face on a child: the attacker had already been violent in the past. Between January 2017 and April 2020, he pushed and hit an 8-year-old girl. André Medgino was on his cell phone when the child wanted to look at the screen. That’s when he pushed her hard and slapped her.

Shortly after, he threatened a woman by text message and sent her voice messages saying he wanted to kill her.

He had to respect a curfew in connection with this file. On the evening of the rape, André Medgino did not respect this order.

Samuel McAuliffe, the defense attorney, said his client has a mild intellectual disability. However, no psychiatric assessment was filed in evidence to attest to this condition.

Sentencing submissions are scheduled for next December.
