The Quebec tramway will not be derailed by the injunction presented urgently by a group of citizens: the Superior Court has just rejected their request, which aimed to suspend preparatory work for this public transport project.
In his decision rendered Thursday, Judge Clément Samson rejected the request of citizens grouped under the term “Quebec deserves better. »
The magistrate concludes that the opponents have failed to demonstrate the urgency of the appeal.
According to him, the preparatory works they fear, such as the felling of trees and expropriations, are not likely to occur in the short term and therefore do not constitute damage that would be irreparable.
“The plaintiffs fail in their demonstration of imminent serious and irreparable harm, the balance of convenience and urgency,” wrote Judge Samson at the end of his decision.
However, unsuccessful citizens retain their right to argue their arguments during the trial on the merits.
According to their lawyer, Me Guy Bertrand, this is only the first round.
“We will continue the battle,” he said.
He notes that the judge left the door open to several of the arguments he had presented in the name of “Quebec deserves better”.
Me Bertrand believes that the trial of the case could take place in October.
It remains to be seen whether the city will continue its work or wait for the outcome of the litigation, he added.
