No burkini in the municipal swimming pools of Grenoble. The Council of State agreed, Tuesday, June 21, to the prefecture of Isère, which opposed its authorization. In its decision, the highest administrative court confirmed the decision of the administrative court of Grenoble rendered at the end of May. The city appealed. Lhe new rules of procedure for the swimming pools of Grenoble, authorizing the wearing of the burkini, had been voted in the municipal council on May 16.
In his long-awaited decision, the interim judge of the Council of State considers, among other things, that the authorization to wear the burkini is “strongly derogating from the common rule”, “enacted for health and safety reasons”. He considers, moreover, that the new swimming pool regulations imposed by the Grenoble municipality constitute a “very targeted derogation” destined to “to satisfy a religious claim”and that she “is likely to affect the proper functioning of the public service and the equal treatment of users under conditions undermining the principle of neutrality of public services”.
This suspension is “the first application of the new ‘referred secularism’ resulting from the law of August 24, 2021 confirming respect for the principles of the Republic”, according to the press release from the Council of State. The Minister of the Interior, Gérald Darmanin, immediately welcomed this decision on Twitter and welcomed the“a victory for the ‘separatism’ law, for secularism and beyond, for the whole Republic”.
