The prefect’s decree fixes a reference rent, an increased reference rent (greater than 20%) and a reduced reference rent (reduced by 30%) depending on the living area, the seniority and the category of the well and geographic areas.
The measure only applies to leases signed as of December 1 “for bare and furnished rentals”. In the event of non-compliance with the increased reference rent, the lessor may be given formal notice at the request of the prefect and must reimburse the overpayment to the lessee. Otherwise, a fine is possible, up to 5,000 euros for a natural person, 15,000 euros for a legal person.
